Facts
Harrell (plaintiff) was injured in a collision and brought suit against the driver responsible for the injury. Harrell was awarded compensatory and punitive damages. The driver paid Harrell the compensatory damages but not the punitive damages. Harrell then brought suit against the driver’s insurance company, Travelers Indemnity Co. (Travelers) (defendant) to recover the unpaid punitive damages. The trial court found that Travelers was not liable. Harrell appealed. The Oregon Supreme Court granted certiorari.
