Facts
Harris Trust & Savings Bank (plaintiff) filed a petition to remove a tract of land from the boundaries of the Village of Barrington Hills (defendant). The land comprised approximately 95 acres on the village’s western border with Carpentersville. The property was the shape of an inverted “L” that was surrounded by Carpentersville on three sides. The land was largely cut off from the rest of the village by the Helm Woods Forest Preserve to the east. The village opposed the petition, arguing that it was filed to avoid the village’s zoning regulations, which required a minimum lot size of five acres. The trial court denied the petition. The appellate court reversed, finding that the disconnection petition should be granted. The village appealed.
