Facts
In 1941, Edward Strawbridge executed an instrument by which he purported to transfer the subject property “to have and to hold unto [his wife] Ethel Strawbridge [plaintiff], her heirs or assigns forever,” in consideration for one dollar. Edward duly signed and acknowledged the document. After Edward died, Ethel sued a number of his heirs to recover title to the subject property, an 189 acre tract. The defendants argued that Ethel was not entitled to the land because the 1941 document violated the statute of frauds. A jury awarded Ethel title to the land and the defendants appealed.
