Harris v. Yellow Transportation Co.
United States District Court for the Northern District of Texas
2008 U.S. Dist. LEXIS 112143 (2008)
- Written by Mary Pfotenhauer, JD
Facts
Freeman Harris (plaintiff) worked for Yellow Transportation Co. (Yellow Transportation) (defendant). While an employee there, Harris received Yellow Transportation’s policy guide, which included the terms of the company’s dispute resolution process, under which the company could compel arbitration. Those terms stated that they applied to all non-union employees, which included Harris, and that acceptance of the terms was a condition of employment. Harris refused to sign the dispute resolution agreement, but continued working for Yellow Transportation. Harris brought suit against Yellow Transportation, alleging race discrimination, harassment, and retaliation. Yellow Transportation moved to compel arbitration.
