Facts
A group of citizens (defendants) destroyed their Tennessee town’s liquor supply to prevent it from falling into the hands of US soldiers. The citizens’ motivation was to prevent acts of violence and destruction that they alleged the soldiers would have committed in a state of intoxication. An owner of some of the lost liquor (plaintiff) brought suit. The trial court found in favor of the defendants. The plaintiff appealed. The Tennessee Supreme Court granted certiorari.
