Facts
Cartwright died as a result of a blow received during an illegal prize fight with Geysel (defendant). The administrator of Cartwright’s estate (plaintiff) brought suit. The complaint did not allege that the fighting was done in anger, that there was malicious intent to cause serious injury, or that there was excessive force. The trial court dismissed the complaint. Cartwright’s estate appealed.
