Facts
Frank Hart (plaintiff) worked as a pipe installer and later developed mesothelioma. Hart sued multiple entities, including Keenan Properties, Inc. (Keenan) (defendants), that were involved in the distribution and use of asbestos-containing pipes. At trial, the question of Keenan’s liability turned on whether it had supplied the pipes for a particular project Hart had worked on. Hart’s supervisor, John Glamuzina, testified that he recalled seeing Keenan’s name and logo on invoices accompanying pipes delivered to Hart’s worksite. The jury returned a verdict for Hart and made a special finding that Hart was exposed to asbestos from pipes supplied by Keenan. The appellate court reversed, concluding that Glamuzina’s description of the invoices constituted inadmissible hearsay. The California Supreme Court granted review.
