Geneyne Hart (plaintiff) sued Nationwide Mutual Fire Insurance Company (Nationwide) (defendant) for limiting the amount of insurance benefits that Hart was entitled to for medical care following an accident. Nationwide reduced Hart’s benefit payments to an amount based on medical-provider charges within Hart’s geographical region. Hart, who sought class-action certification for others similarly situated, asked the court for an order to compel pre-certification discovery of Nationwide’s files, including all its PIP files, that would aid Hart in establishing that she could meet the requirements for class-action certification. Nationwide alleged that Hart’s discovery requests were unreasonably broad and unrelated to her individual claims.
