Facts
Malik Hasan (plaintiff) bought wine from Premier Cru Fine Wines (Premier Cru) using credit cards issued to him by Chase Bank USA, N.A., and American Express Centurion Bank (the issuers) (defendants). Before Hasan received the wine, Premier Cru went bankrupt. Hasan sued the issuers under § 1666i of the Fair Credit Billing Act, § 170 of the Truth in Lending Act, seeking a refund of the price he paid. Hasan stated in his complaint that he had fully paid off both credit cards. The district court dismissed Hasan’s complaints because he had paid off the credit cards.
