Facts
Takara Co., Ltd., a Japanese manufacturer, designed and manufactured The Transformers series of changeable robotic action figures. Takara authored designs for the Topspin and Twin Twist set of models to be included in The Transformers series and created molds for their manufacture. These molds did not contain a notice of copyright. About 213,000 unmarked models were sold before Takara assigned its United States rights in The Transformers series to Hasbro Bradley, Inc. (plaintiff). Meanwhile, Sparkle Toys, Inc. (defendant) copied and sold the models manufactured by Takara that did not contain a notice of copyright. Hasbro initiated suit, and the district court granted Hasbro a preliminary injunction prohibiting Sparkle from distributing, selling, or otherwise exploiting the infringing models in the United States. Sparkle appealed.
