Facts
Heidi Hassell (plaintiff) contracted with John Wenglinski (defendant) to provide home healthcare services in Wenglinski’s home. One day, as Hassell voluntarily walked Wenglinski’s two dogs as a favor for her employer, the dogs tugged on their leashes, pulling Hassell forward and causing Hassell to fall and sustain bodily injury. Hassell invoked the Illinois Animal Control Act (ACA) to sue Wenglinski for damages. The trial court summarily dismissed the case. Hassell appealed to the Illinois Appellate Court.
