Facts
Hassneh Insurance Co. of Israel (Hassneh) (plaintiff) entered into a reinsurance contract containing an arbitration agreement with Mew (defendant). Mew placed the Hassneh reinsurance contract with C.E. Heath Co (Heath), an insurance broker. After Mew incurred certain losses, Mew sought payments from Hassneh under the contract. Hassneh refused payment, and Mew referred the dispute to arbitration. The arbitration occurred in England under the English Arbitration Act. The tribunal rejected Mew’s claim and issued an award in favor of Hassneh. Mew then brought a lawsuit against Heath, the third-party insurance broker. Mew stated its intention to disclose the Hassneh arbitral award in its litigation with Heath. Although Mew did not disclose an intention to disclose documents from the arbitration, Hassneh intervened, filing for an injunction to restrain Mew from disclosure of documents from the arbitration.
