Hatteras of Lauderdale, Inc. v. Gemini Lady
United States Court of Appeals for the Eleventh Circuit
853 F.2d 848 (1988)

- Written by Alex Ruskell, JD
Facts
Hatteras of Lauderdale, Inc. (Hatteras) (plaintiff) sued the Gemini Lady (defendant), a vessel, in relation to customization that Hatteras had done to the Gemini Lady, including refinishing running lights and installing a custom glass enclosure. Hatteras brought the claim in federal court, arguing that it was an admiralty claim entitled to federal subject-matter jurisdiction. The Gemini Lady filed a motion to dismiss and for the imposition of sanctions, arguing that Hatteras’s claim was not an admiralty claim because it involved a sales or construction contract for a boat. The court ruled in favor of the Gemini Lady, and Hatteras appealed.
