Facts
Community Bank of Raymore (defendant) required Hawkins (plaintiff) to execute a personal guaranty for loans taken by her husband’s business solely because Hawkins was married to her husband. Hawkins sued Community, alleging Community violated the Equal Credit Opportunity Act’s prohibition on discrimination due to marital status. Community moved for summary judgment, arguing Hawkins was not protected by the act because she was not an applicant under the act. The court granted Community’s motion, and Hawkins appealed.
