Facts
Henry Sawyer issued a bond to Hay (plaintiff), which Fortier (defendant) signed as a surety, promising to be responsible for the debt. The conditions of the bond were not met, and Fortier was requested to pay the debt. Fortier sent a letter to Hay stating that she would pay $100 the following week and the remaining amount before April. Hay replied by letter, stating that he would accept the $100 immediately and the balance before April. Fortier paid the $100, but not the remainder. Hay brought suit against Fortier for her failure to pay the remainder by April, as promised in her letter.
