Facts
Biggins (plaintiff) worked for Hazen Paper Co. (Hazen) (defendant) as the company's technical director for nearly a decade. In 1986, he was fired at the age of 62, weeks before his employee pension benefits plan would have vested. Biggins sued Hazen, alleging he was wrongfully terminated on the basis of his age in violation of the Age Discrimination in Employment Act (ADEA), 29 U.S.C. §623(a)(1), and to prevent his pension from vesting in violation of the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §1140. Hazen claimed Biggins was fired for conducting business with its competitors. Biggins succeeded in federal district court on both his ADEA and ERISA claims, and the United States Court of Appeals for the First Circuit affirmed. Hazen sought review by the United States Supreme Court.
