Facts
Estelle Hecht (plaintiff) sued the City of New York (city) and Square Depew Garage Corporation (garage) (defendants), alleging that the city and the garage negligently maintained a sidewalk in front of the garage, which led Hecht to fall and be injured. After a trial, the jury found the city and the garage to be equally negligent. The city appealed to the appellate division, but the garage did not appeal. The appellate division concluded that any defect in the sidewalk was too trivial to be actionable and thus dismissed Hecht’s complaint against the city. The appellate division further vacated the judgment against the garage, despite the fact that the garage did not appeal its loss at trial. Hecht appealed the dismissal of her claims against both the city and the garage.
