Facts
The City of Two Rivers (defendant) employed Christopher Heder (plaintiff) as a firefighter. The city decided to have its firefighters become certified as paramedics. The city and the firefighters’ union made a deal that included a 3 percent wage increase for firefighters who were certified and a requirement that any firefighter leaving employment with the city within three years would repay the cost of the paramedic training. Heder quit two and a half years after his training. The city withheld Heder’s pay in entirety from his last two pay periods. Heder sued the city, claiming that the city violated the Fair Labor Standards Act (FLSA). The city counterclaimed for the balance of the cost of Heder’s training. The city conceded that the FLSA required that it pay Heder the statutory minimum wage for his last two pay periods. The district court found that the repayment obligation in the collective-bargaining agreement was a covenant not to compete and invalid under state law. The city appealed.
