Heiman v. Parrish
Kansas Supreme Court
942 P.2d 631 (1997)
- Written by Sean Carroll, JD
Facts
Jerod Heiman (plaintiff) bought Heather Parrish (defendant) an engagement ring and gave it to her when she agreed to marry him. Later, Jerod called off the wedding and asked Heather to return the ring. Heather refused, and Jerod brought suit. The trial court held that the gift of the ring was a conditional gift and therefore revocable. Heather appealed, arguing that the gift of the ring was a valid, completed inter vivos gift.
