Facts
Dorothy Heino (plaintiff) was riding in a car with her husband, Arno Heino. Arno was driving, and Dorothy sat in the passenger’s seat. At an intersection, Arno turned left into an oncoming car, causing a collision. The oncoming car was driven by Roy Harper (defendant). Dorothy sued both Arno and Harper for her injuries. She alleged that Arno had driven the car negligently. Arno moved to dismiss Dorothy’s suit, arguing that he was immune from tort liability under the doctrine of interspousal immunity. The trial court granted Arno’s motion, entering judgment in favor of Arno. Dorothy appealed, and the court of appeals affirmed.
