Facts
Jenna Helf (plaintiff) worked at an oil refinery owned by Chevron U.S.A., Inc. (Chevron) (defendant). Helf followed her supervisor’s instruction to add sulfuric acid to an open-air waste pit and was severely injured by the resulting chemical reaction. Helf obtained workers’-compensation benefits and subsequently sued Chevron for an intentional tort, arguing that her injuries were the result of her supervisor’s instructions. Chevron filed a motion for summary judgment, arguing that Helf’s tort claim was barred by the doctrine of election of remedies. The trial court denied the motion for summary judgment, and Chevron appealed.
