Henslee v. Singleton
United States Court of Appeals for the Fourth Circuit
2018 WL 1252120 (2018)
Facts
Jonathan Leigh Henslee (plaintiff), a prisoner, was sprayed in the face with pepper spray by Marty Singleton (defendant), a prison guard. Henslee brought a civil suit, alleging that Singleton used excessive force against him. At the trial, the district-court judge admitted evidence of Henslee’s prior felony convictions under Federal Rule of Evidence 609(a)(1). The judge instructed the jury that Henslee’s prior felony convictions were to be considered only for the purpose of assessing Henslee’s credibility. Subsequently, the jury ruled in favor of Singleton. Henslee appealed.
