Facts
Hepburn (plaintiff) was a doctor at a family-planning clinic. During a television broadcast program aired by TCN Channel Nine Pty. Ltd. (TCN) (defendant), statements were made about Hepburn performing abortions. Hepburn sued TCN for defamation. There was an issue presented at trial as to whether the term “abortion” was defamatory and whether there was an issue that should be submitted to the jury. The trial court’s decision was appealed.
