Facts
Detroit Edison, an electric company, acquired a prescriptive easement in gross over the Heydons’ (plaintiffs) property to install utility poles and electrical wires in order to provide electric service. Edison contracted with MediaOne (defendant) to permit MediaOne to place cable television wires on these utility poles for purposes of providing cable television service. The Heydons sued MediaOne for trespass. The trial court dismissed the Heydons’ complaint. The Heydons appealed.
