Facts
The owner of a truck (defendant) left the truck in the middle of a road at night with no lights on. A car driving on the road crashed into the parked truck. A passenger in the car (plaintiff) brought a negligence suit against the truck owner. The trial court concluded that the driver of the car was negligent and dismissed the passenger’s complaint. The passenger appealed.
