Facts
Cary Hill (plaintiff), a four-year-old child, was allegedly bitten by Skinner’s (defendant) dog. Cary’s parents brought suit and the only direct testimony that the dog actually attacked Cary was Cary’s testimony. Skinner sought to preclude the testimony as incompetent on account of Cary’s youth. The Court of Common Pleas of Summit County admitted the testimony and found in favor of Cary for $500. Cary appealed for the destruction of the dog as was required by the state statute.
