Facts
Jimmy Hillard (plaintiff) contracted to purchase real property from Buddie Ruth Franklin (defendant). Before closing, fire destroyed a house on the property. Hillard sued Franklin for specific performance, seeking a reduction in the property’s purchase price by the amount Franklin’s insurer paid to cover the house’s loss. The trial court granted summary judgment for Hillard, and Franklin appealed to the Tennessee Court of Appeals.
