Facts
Diana Hilburn (plaintiff) was injured in a car accident with a truck owned by Enerpipe Ltd. (defendant). Hilburn sued Enerpipe for negligence. The jury awarded Hilburn $33,490.86 for medical expenses and $301,509.14 for noneconomic damages, totaling $335,000. Kansas had a law that placed a $250,000 cap on jury awards for noneconomic damages. Hilburn argued that the cap violated her constitutional right to a trial by jury. The Kansas Constitution provided that the right to a jury trial was inviolate.
