Facts
Students International Meditation Society (the society) (defendant) rented out part of a resort owned by Hiram Ricker & Sons (Ricker) (plaintiff) for a training course. The society made period payments to Ricker during the course, but Ricker believed that the society brought more people to the resort than the parties had discussed. On the last day of the course, the society presented a calculation sheet to Ricker with a total balance that the society believed it owed. Ricker sued the society to recover additional payments it believed the society owed. At trial, the court permitted Ricker to introduce the calculation sheet that the society had presented. The trial court ruled in Ricker’s favor. The society appealed, arguing that the calculation sheet should not have been admitted into evidence.
