Facts
HKL Group Co. Ltd. (HKL) (plaintiff) filed an action against Rizq International Holdings PTE (Rizq) (defendant) in Singapore for missed payments related to a contract for the sale of sand. The contract contained an arbitration clause, written without legal counsel, that provided for binding arbitration by the “Arbitration Committee at Singapore” under the arbitration rules of the International Chamber of Commerce (ICC). Rizq requested that the Singapore court stay the proceedings for the parties to arbitrate the dispute. HKL argued in response that the arbitration clause was clearly inoperative, and therefore defective, because there was no arbitral institution named the “Arbitration Committee at Singapore.”
