Facts
The plaintiff shipped eel skins to the defendant and the defendant kept the skins for several months without notifying the plaintiff of whether the defendant had accepted and agreed to pay for the shipment. The skins were eventually destroyed because of this delay. Previously, the plaintiff had shipped skins in the same manner to the defendant about four or five times, and the defendant accepted and paid for the shipment each time. The plaintiff brought suit and the trial court found in his favor. The defendant appealed.
