Facts
Carol Hobson (plaintiff) was shopping at a Dollar General store owned by Dolgencorp, LLC (defendant) when, according to Hobson, a store employee stopped her in the store, believing that she had stolen merchandise in her bag. The employee called the police, and 30 minutes later, the police conducted a full search of Hobson’s bag in full view of other shoppers. No merchandise was found. Hobson felt embarrassed and humiliated by the encounter. Hobson sued Dollar General, alleging false imprisonment. Dollar General moved for summary judgment based on the shopkeeper’s privilege.
