Facts
Two lawsuits brought under the Fair Labor Standards Act (FLSA) and the Equal Pay Act were consolidated. In the first, three female employees (female employees) (plaintiffs) of Miller Brewing Co. (Miller) (defendant) filed suit against Miller to recover back pay, liquidated damages, and attorneys’ fees under 29 U.S.C. § 216(b). In the second, the secretary of labor (plaintiff) filed suit to enjoin Miller from paying discriminatory wages to females under 29 U.S.C. § 217. The district court entered judgment requiring Miller to equalize wage rates and pay the female employees back pay (without interest) and liquidated damages, finding the latter appropriate because Miller did not act in good faith to comply with equal-pay requirements. Miller appealed, arguing that the court should not have awarded liquidated damages because Miller acted in good faith by relying upon a summary of unpaid wages issued by a Department of Labor investigator, as well as certain state-court determinations regarding Miller’s liability for discrimination under substantially similar state laws. The female employees also cross-appealed the district court’s denial of interest.
