Facts
Under North Carolina law, children were entitled to the opportunity for a sound basic education. The Hoke County Board of Education (board) (plaintiff) filed suit against the State of North Carolina and the State Board of Education (defendants) for failing to provide the resources and funds needed to guarantee that opportunity for its students. The board argued, and evidence demonstrated, that an increase in early-education opportunities would significantly increase the quality of the education students in Hoke County received. The trial court ruled in favor of Hoke County and ordered the state to (1) take responsibility for and correct the failure to provide needed resources and funds and (2) expand prekindergarten educational programs for at-risk students. The state appealed to the North Carolina Supreme Court.
