Facts
Dr. Coggins left the residue of his estate to the Keswick Home, which was formerly known as the Home for Incurables of Baltimore City (Keswick). Dr. Coggins’s will provided that Keswick should use the money to construct a new housing building “to house white patients who need physical rehabilitation.” The will provided further that if this was not acceptable to Keswick, the money should go to the University of Maryland Hospital (the hospital) for physical rehabilitation.
