Facts
Robert Hoover (defendant) was in an interracial marriage with a White woman. Because interracial marriages were prohibited by law, the marriage was deemed void, and Hoover was charged with fornication for cohabiting with his wife. At trial, Hoover sought to introduce evidence that a probate judge had told him it was legal for him to marry a White woman. The circuit court refused to admit this testimony, and Hoover was convicted as charged.
