Facts
Hormel Foods Corporation (Hormel) (plaintiff) had a contract with Crystal Distribution Services, Inc. (Crystal) (defendant) pursuant to which Crystal promised to store Hormel’s products under certain conditions. Crystal breached the contract by storing Hormel’s products in a low warehouse floor, and the products were damaged by flooding. Hormel suffered $4 million in losses and sued Crystal for breach of contract. Hormel filed a motion in limine to exclude evidence that its insurers had covered approximately $3 million of its losses, and the trial court considered Hormel’s motion.
