Horn & Leibowitz v. Histadrut
Israel Labor Court
Collective Dispute Appeal 1008/00, 35 PDL 145 (2000)

- Written by Whitney Waldenberg, JD
Facts
Horn & Leibowitz (defendant) was a private transportation company that employed 217 bus drivers. Eighty-three of the bus drivers belonged to Histadrut (plaintiff), a workers’ labor union. Histadrut attempted to negotiate a collective-bargaining agreement on behalf of the workers, but Horn & Leibowitz refused the new terms. Thirty-five of the Histadrut members went on strike, and Horn & Leibowitz fired the striking workers. Histadrut filed a suit against Horn & Leibowitz, seeking to reinstate the employment of the fired workers. The lower court ruled in favor of Histadrut, and Horn & Leibowitz appealed.
