Facts
Buford Zimmerman (defendant) and his friend, Orville Higbee, were teenage boys in the habit of borrowing a car from Zimmerman’s father and taking girls on joy rides. On one such occasion, while Higbee was driving and Zimmerman was in the backseat, the car collided with another, killing the wife of Joseph Howard (plaintiff). Howard brought suit. The trial court found in favor of Howard. Zimmerman appealed. The Kansas Supreme Court granted certiorari.
