Facts
Kroger Company (defendant) leased a portion of a shopping center for one of its stores. The lease provided that the landlord would maintain the common areas, including removing snow and ice on the sidewalks. Delores Howe (plaintiff) slipped and fell on ice on the sidewalk outside of Kroger’s store. Howe brought suit against Kroger to recover for her injuries. Kroger argued that only its landlord was liable. The trial court granted Kroger summary judgment. Howe appealed.
