Facts
The Food and Drug Administration issued a circular warning the public that the Hoxsey Cancer Clinic’s (plaintiff) cancer treatment was worthless. The circular was posted in post offices throughout the country. Hoxsey sued, arguing that the section in the Food, Drug, and Cosmetic Act allowing such publication violated due process because it did not provide for a hearing before information about a product was published.
