Facts
Jennifer Braddock was repeatedly abused by James Hudson, the father of her son. A Tennessee state court issued three protective orders against Hudson, which Hudson repeatedly violated. Braddock reported such violations to the police on multiple occasions, but the police took no action against Hudson. One night, Hudson’s sister, Susan Hudson (defendant) drove him to Braddock’s home. At this point, Hudson shot and killed Braddock, her two friends, and himself. Braddock’s son and mother (plaintiffs) brought suit against Hudson’s sister, the Memphis Police Department, and several police officers (defendants). Braddock’s son and mother claimed that the Memphis Police violated Braddock’s Fourteenth Amendment rights by not sufficiently enforcing the protective orders. The district court denied extending qualified immunity to the police officers.
