Facts
Hufstetler (defendant) drove an automobile with several other men inside to a gasoline service station. One of the men in the vehicle got out and asked the owner of the station to fill up the car with gas. The owner put six and a half gallons of gas worth $1.94 into the vehicle. After the same man asked the owner to go get a quart of oil, Hufstetler and the other men sped away without paying. Hufstetler was tried without a jury and found guilty of petit larceny. Hufstetler appealed.
