Facts
The owners of the Three Captains House of Seafood Restaurant (plaintiff) sued the town of Bladensburg (defendant) requesting a temporary restraining order to enjoin the enforcement of a new ordinance prohibiting topless dancing in establishments that served food or alcohol. According to the restaurant, which had topless dancing before the ordinance was enacted, the ordinance had caused the restaurant to operate at a loss and face potential closure.
