Facts
Donata Delulio (plaintiff) was an attorney for the Celanese Corporation (Celanese) (defendant). In her role, Delulio defended Celanese in a potential class-action lawsuit under Title VII of the Civil Rights Act of 1964 alleging discrimination in employment on the basis of sex. As part of her representation, Delulio studied the applicable regulations, obtained and reviewed internal data on salaries and hiring practices, participated in meetings with experts retained to prepare the defense, and drafted memoranda. Delulio then sought to join the case as a party by filing an intervention motion, alleging that she suffered various forms of sex discrimination by Celanese.
