Facts
Deidre Hunt (defendant) began an affair with Konstantinos Fotopoulos. Fotopoulos, who had been engaged in criminal activity, was being blackmailed by Kevin Ramsey, a former employee. One day, Fotopoulos, Hunt, and Ramsey went out to the woods, where Fotopoulos tied Ramsey to a tree. Fotopoulos then held a gun to Hunt’s head and ordered her to shoot Ramsey. Hunt shot Ramsey several times and killed him. Hunt was convicted of first-degree murder. Hunt appealed, arguing that the trial court erred in failing to instruct the jury as to a necessity defense.
