Facts
The Town of Huntington (defendant) had a zoning ordinance that restricted multi-family housing projects to a predominantly minority neighborhood (urban renewal area). The Huntington Branch of the NAACP along with Housing Help, Inc. (NAACP) (plaintiffs) sought to build an integrated, subsidized apartment complex in a virtually all-white neighborhood, outside the urban renewal area. NAACP petitioned the town to revise its zoning restriction on this area, but the town refused. NAACP brought a class-action suit claiming a violation of the Fair Housing Act. The district court found in favor of the town. NAACP appealed.
