Facts
Hynix Semiconductor Inc. (Hynix) (plaintiff) sought to call Ilan Krashinsky as a lay witness. Krashinsky was an engineer with significant experience in circuit design and planned to testify about the extent of an industry lock-in due to an industry standard known as dynamic random-access memory (DRAM). Krashinsky also sought to testify about how much it would cost the industry if the industry were forced to use different DRAM standards. Rambus Inc. (defendant) filed a motion to exclude the testimony on the ground that it was impermissible lay testimony. Hynix argued that Krashinsky’s engineering experience was sufficient foundation for the lay testimony.
