Facts
A Swiss buyer (plaintiff) contracted to buy fertilizer from an Austrian seller (defendant). The contract obligated the buyer to send fertilizer sacks, as specified by the seller, to the seller’s Ukrainian supplier. The sacks failed to meet Ukrainian industry standards, and therefore the supplier was unable to deliver the fertilizer on time. When the seller balked at committing to a new delivery date, the buyer purchased fertilizer elsewhere and commenced international arbitration proceedings against the seller.
