Facts
Richard K. Wager (defendant) published an article called “Militant Sues Red Hook” in a publication read by 45,000 people per day. The subject of the article was Jonathon Keith Idema and his group Counterr Group, Inc. (plaintiffs), an organization dedicated to police and military training. Idema objected to Wager’s use of the word “militant” in the article; Idema thought it implied an attempt at overthrowing the government. Idema wrote Wager and asked him to retract the article and issue him an apology. Wager refused. Idema brought an action for libel and defamation. Wager moved to dismiss the complaint.
